The new Human under Law Recognition
(HL)

HD : Homme à reconnaître juridiquement

This site is about a Human whom the law — and, more broadly — all of us have always failed to acknowledge.

The Human that does not exist yet must exist in the eyes of the Law

The illustration refers to Themis, the goddess of Justice in Greek antiquity. Each scale represents a Human - both the one who exists and the one who is yet to come - whom justice and the Law must consider to ensure that no one is denied legal recognition

The legal recognition of every Human is the fundamental principle of our modern societies, driven by humanism.

Today, Humanity is called to understand that legal recognition must not - as it is right now - be limited to the Human who exists, but must also extend to the Human who does not yet exist and is to come:

I/. The legal recognition of the Human to come.

Identifying the legal recognition of the Human yet to come by questioning the presence of someone tomorrow:

II/. The legal recognition of the Human to come and the case of the embryo.

From the case of the young girl to that of the embryo by questioning the other Human who is yet to come:

III/. The legal recognition of the Human to come and the protection of the embryo.

The question of whether or not to preserve the embryo no longer depends on what it is (A), but on who it is destined to become (B):

A. The protection of the embryo depends on what it is (the Error).

Currently, the Human under consideration is the Human that exists. So, in the case of the embryo, attention is only paid to the embryo that exists, and the question is:

"Is the embryo a Human?"

B. The protection of the embryo depends on the Human it is destined to become tomorrow (end of the Error).

Understanding today the value of the Human to come, we understand that the embryo must be protected, because:

"Tomorrow, the embryo is a Human!"

Synthesis :

Asserting the existence of a Human's Right, and then determining which Human is truly protected by that Right:

Girl's case:

Initial question:
"Do you want her to be here tomorrow?"

Answer:
"I surely do!
This girl has to be here tomorrow!"

"This girl has the Right to be here tomorrow!"

"The One this girl is destined to become has the Right to be here tomorrow!"

Embryo's case:

"The One the embryo is destined to become has the Right to be here tomorrow!"

"To protect the embryo because of the Right of the One it is destined to become to be here tomorrow."

Aparté/
The acknowledgment yesterday of the Right to be here today:

The legal recognition of the Human to come can likewise be understood by questioning the act that yesterday may have deprived another of being here today:

- Yesterday, 10 years ago, an accident was averted. Would you have accepted that this young man was killed by that accident?

- Certainly not!

- And, why not?

- Otherwise, he would not be here today.

- So you recognise that 10 years ago, this young man had the Right to be here today?

‍- Indeed.

- However, 10 years ago, did this young man exist at that time?

- No, he did not ?
10 years ago, this young man was yet to come.
- This young man was also yet to come 21 years ago. Didn't he have the same Right to be here today at this time, 21 years ago?

- Certainly! The same person cannot be treated differently because of the given moment.

- However, 21 years ago, this young man was only an embryo.

Annexes

The legal personality has to be attributed to the One to come.

Is the crown of flowers placed on the head of every Human? Are all Humans anointed today ? Are none missing, and can the laurel of peace truly be raised ? We believe so, but it is not the case if the crown is also to be placed on the head of the One to come.

The new Right to Life.

The vessel must not be destroyed, not for its own sake, but for the sake of the precious water it holds. And so it is with the Right to life: we must not be killed because of all the life we have yet to live.

Essay on the Right to life and its beneficiary.

In the name of this Right, it is the presence of this child along this path that is to be protected. However, is this child limited to the one he is today that we find all along this path?

Assessment:

This child is the reality of tomorrow. This is her face. However, since this child is not a reality today, we believe that this child doesn't deserve any consideration.

Except that we hadn't understood that the one we consider in every Human is not only the reality that he/she is today, but also the reality that he/she is going to be tomorrow!"

De lege feranda
(the law that must be)

Can we dispute the deduction that the Human whose presence we desire tomorrow is the one who is yet to come?

If this deduction is irrefutable,
then we must accept all its consequences, and therefore acknowledge that every Human who is to come has the Right to be here tomorrow.

It becomes everyone's responsibility and duty to defend this Human and to take necessary action to ensure his or her Right to exist is recognised by law.

Tomorrow, it must be not just one, but two children walking along this beach.
